Together, these documents form the agreement between you and Eloria.
Nothing contained within these Terms is intended to limit or exclude any rights granted to consumers under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, the Protection of Personal Information Act 4 of 2013 (POPIA) or any other applicable South African legislation.
Where any provision of these Terms conflicts with mandatory South African law, the applicable law will prevail.
1. Eligibility
By using this website or purchasing from Eloria, you confirm that:
- you are at least 18 years of age; or
- you have the consent and supervision of a parent or legal guardian.
You also confirm that all information you provide is accurate, complete and up to date.
Providing false, misleading or fraudulent information may result in Eloria refusing or cancelling an order where permitted by law.
2. Use of Our Website
You agree to use the Eloria website only for lawful purposes.
You must not:
- use the website for fraudulent purposes;
- interfere with the operation or security of the website;
- attempt to gain unauthorised access to any part of the website;

Customers may purchase products without creating an account where this option is available.
If you create an account with Eloria, you are responsible for:
- maintaining the confidentiality of your login details;
- restricting access to your account;
- ensuring your information remains accurate and up to date; and
- all activity carried out using your account unless caused by Eloria's negligence or a security failure within our systems.
Please notify us immediately if you believe your account has been accessed without your permission.

By using our website or placing an order, you consent to receiving communications from Eloria electronically where permitted by law.

Eloria continually works to improve its products and website.
We reserve the right to:

Such changes will not affect completed transactions except where required by law or where the customer agrees otherwise.

While Eloria aims to keep the website available at all times, we do not guarantee uninterrupted access.

- technical faults;
- internet service interruptions;
- security incidents;
- third-party service failures; or
- circumstances beyond our reasonable control.
Where reasonably possible, Eloria will work to restore normal service as soon as practicable.

If you do not agree with any part of these Terms, you should discontinue use of the website and refrain from placing orders.
9. Products
Eloria specialises in meaningful jewellery designed to inspire and celebrate life's journey.
We make every reasonable effort to ensure that all product descriptions, photographs, videos and other content accurately represent our products.
However, customers acknowledge that:
- Colours may vary slightly depending on individual screen settings and device displays.
- Product images are intended for illustration purposes and may differ slightly from the final product due to lighting, photography or natural materials.
- Minor variations that do not materially affect the quality or function of the product may occur.
Where a product supplied differs materially from its description, customers retain all rights available under applicable South African law.
10. Product Materials
Unless otherwise stated on the relevant product page, Eloria jewellery is manufactured using carefully selected materials, including:
- Stainless Steel;
- 18K Gold Plating (where applicable); and
- Resin Inlay.
Individual product pages may contain additional information regarding materials or finishes specific to that product.
Customers with known allergies or metal sensitivities should carefully review the product description before purchasing.
Although we strive to use quality materials, Eloria cannot guarantee that every material will be suitable for every individual.
Nothing in this section limits any rights relating to defective or incorrectly described products.
11. Natural Materials
Some Eloria jewellery contains a genuine mustard seed enclosed within a protective resin inlay.
Because every mustard seed is naturally unique, slight differences in:
- Shape;
- Size;
- Colour;
- Texture; and
- Appearance
may occur between products.
These natural characteristics contribute to the uniqueness of each necklace and are not considered manufacturing defects.
12. Product Availability
All products displayed on the Eloria website are subject to availability.
Eloria operates a business model in which certain products are ordered from our supplier after a customer successfully places an order.
Although we make every reasonable effort to maintain product availability, circumstances beyond our control may occasionally result in a product becoming unavailable after an order has been placed.
If this occurs, Eloria may:
- offer an alternative product of similar value;
- allow the customer to wait until stock becomes available; or
- provide a full refund for the unavailable product.
Customers are under no obligation to accept an alternative product.
13. Placing an Order
By placing an order through the Eloria website, you are making an offer to purchase the selected products.
All orders remain subject to acceptance by Eloria.
After placing an order, customers will receive an order confirmation email acknowledging receipt of the order.
This confirmation does not constitute acceptance of the order.
An order is considered accepted once:
- payment has been successfully authorised;
- the order has entered processing; and
- Eloria has confirmed that the order can be fulfilled.
Eloria reserves the right to refuse or cancel an order where reasonably necessary and permitted by law.
14. Order Acceptance & Cancellation
Eloria may decline or cancel an order where there is reasonable evidence of circumstances including, but not limited to:
- suspected fraud;
- unauthorised payment methods;
- incorrect pricing caused by a genuine error;
- product unavailability;
- incomplete or inaccurate customer information;
- duplicate orders placed unintentionally;
- technical errors affecting the transaction; or
- circumstances that would make fulfilment impossible or unlawful.
Where payment has already been received for a cancelled order, Eloria will refund the amount paid using the original payment method unless another lawful arrangement is agreed.
15. Pricing
All prices displayed on the Eloria website are shown in South African Rand (ZAR).
Unless otherwise stated:
- prices include the product only;
- shipping costs are calculated separately at checkout;
- promotional discounts are applied where applicable before payment.
Current standard delivery charges are:
- Flat Rate Shipping: R89
- Free Standard Delivery: Orders over R1,047
Eloria reserves the right to change pricing, shipping charges and promotional offers at any time.
Price changes will not affect orders that have already been accepted.
16. Pricing Errors
While Eloria makes every reasonable effort to ensure pricing accuracy, genuine pricing errors may occasionally occur due to technical issues or human error.
If a product is displayed with an obvious pricing error that a reasonable customer would recognise as incorrect, Eloria reserves the right to:
- correct the error;
- cancel the affected order; or
- offer the customer the opportunity to purchase the product at the correct price.
If payment has already been processed, any cancelled order will receive a full refund.
Nothing in this section limits any rights available to consumers under applicable South African law.
17. Promotions & Discount Codes
From time to time, Eloria may offer promotional discounts, launch offers or discount codes.
Unless otherwise stated:
- promotions are valid only during the advertised promotional period;
- discount codes may not be combined unless expressly permitted;
- promotions may exclude selected products;
- discount codes have no cash value;
- promotions may not be transferred, resold or exchanged for cash.
Eloria reserves the right to withdraw or amend promotions where reasonably necessary, provided doing so does not affect rights that have already arisen under accepted transactions.
18. Misuse of Promotions
Eloria reserves the right to cancel or refuse any order where there is reasonable evidence that a promotion or discount has been obtained or used through:
- fraud;
- technical manipulation;
- duplicated promotional codes;
- unauthorised distribution;
- abuse of promotional offers; or
- any other dishonest conduct.
Where an order is cancelled for these reasons after payment has been received, Eloria will refund any amount that is lawfully due.
19. Personal Use & Resale
Eloria products are intended for personal use unless otherwise agreed in writing.
Eloria reserves the right to limit, refuse or cancel orders where there is reasonable evidence that products are being purchased for unauthorised commercial resale or distribution.
Nothing in this section prevents legitimate business-to-business arrangements where agreed with Eloria in advance.
20. Product Changes
Eloria continually reviews and improves its products.
Accordingly, we reserve the right to:
- improve product designs;
- update packaging;
- modify product descriptions;
- improve materials where appropriate;
- discontinue products; or
- introduce new products,
provided that these changes do not materially reduce the quality of products already purchased or otherwise conflict with applicable South African law.
21. Payment
All payments made through the Eloria website are processed securely using the payment methods available at checkout.
By placing an order, you confirm that:
- You are authorised to use the selected payment method;
- The payment information provided is accurate and complete;
- Sufficient funds are available to complete the purchase; and
- The transaction is lawful.
Eloria does not store your full payment card details. Payment information is securely processed by trusted third-party payment providers.
Orders will only enter processing once payment has been successfully authorised and received.
22. Fraud Prevention
To protect both our customers and Eloria, we reserve the right to carry out reasonable verification checks before processing an order.
Eloria may delay, decline or cancel an order where there is reasonable evidence of:
- Fraudulent activity;
- Unauthorised payment methods;
- Stolen payment details;
- Identity theft;
- False customer information;
- Chargeback abuse;
- Suspicious ordering patterns; or
- Any other activity reasonably believed to be unlawful.
Where appropriate, Eloria may request additional information to verify an order before processing it.
Nothing in this section limits any rights available under applicable South African law.
23. Shipping & Delivery
Eloria currently delivers within South Africa only.
Current delivery estimates are:
- Standard Delivery: 8–11 Business Days
- Flat Rate Shipping: R89
- Free Standard Delivery: Orders over R1,047
Delivery estimates begin after successful payment and order confirmation.
These timeframes are estimates only and may occasionally be affected by circumstances outside Eloria's reasonable control, including supplier delays, courier delays, severe weather, public holidays or other unforeseen events.

24. Risk & Delivery
Eloria remains responsible for the goods until they have been delivered in accordance with applicable South African law.
Customers should inspect their parcel as soon as reasonably possible after delivery.
If an item appears damaged, incorrect or incomplete, customers should notify Eloria as soon as reasonably possible and follow the procedure outlined in our Return & Refund Policy.
25. Returns & Refunds
Returns, exchanges and refunds are governed by Eloria's Return & Refund Policy.
Customers must contact Eloria before returning any product.
Where a return is approved, Eloria will provide the appropriate return instructions and return address.
Nothing contained in these Terms limits any rights available to consumers under applicable South African law.
26. Chargebacks
Eloria is committed to resolving customer concerns fairly and efficiently.
If you experience a problem with your order, we encourage you to contact Eloria before initiating a chargeback through your bank or payment provider.
This gives us an opportunity to investigate the matter and, where appropriate, resolve it promptly.
Nothing in this section limits your legal right to dispute a payment through your bank, payment provider or any other lawful dispute-resolution process.
Where a chargeback is initiated in circumstances involving fraudulent claims, intentional misuse or dishonest conduct, Eloria reserves the right to provide relevant documentation to the payment provider in defence of the transaction.
27. Intellectual Property
Unless otherwise stated, all content displayed on the Eloria website is owned by or licensed to Eloria and is protected by applicable intellectual property laws.
This includes, but is not limited to:
- The Eloria name and branding;
- Logos;
- Product photographs;
- Product descriptions;
- Meaning card wording;
- Website design;
- Graphics;
- Marketing materials;
- Videos;
- Written content; and
- Other original creative works.
No content may be copied, reproduced, distributed, modified, republished or used for commercial purposes without Eloria's prior written permission.
Unauthorised use of Eloria's intellectual property may result in legal action where appropriate.
28. Customer Reviews & User Content
Customers may voluntarily submit reviews, comments, photographs or other content relating to Eloria products.
By submitting such content, you confirm that:
- The content is truthful and based on your genuine experience;
- You own the rights to the content or have permission to share it;
- The content does not infringe the rights of any third party;
- The content is not unlawful, defamatory, misleading or abusive.
By submitting reviews or content, you grant Eloria a non-exclusive, royalty-free, worldwide licence to display, reproduce and use that content for purposes including:
- Customer reviews;
- Marketing;
- Website content;
- Social media; and
- Promotional material.
Where practical, Eloria will not materially alter the meaning of customer reviews.
Eloria reserves the right to remove content that is fraudulent, offensive, unlawful or inconsistent with these Terms.
29. Prohibited Conduct
When using the Eloria website, customers agree not to:
- Violate any applicable law;
- Use false identities or misleading information;
- Attempt to interfere with the operation or security of the website;
- Upload viruses or malicious software;

While Eloria carefully selects these providers, we are not responsible for their independent policies, systems or services.

However, to the fullest extent permitted by applicable South African law, Eloria does not guarantee that:
- the website will always be available without interruption;
- the website will always be free from technical errors;
- all information will remain accurate at all times;
- every product will meet every customer's personal expectations; or
- colours displayed on individual devices will exactly match the physical product.
Product photographs are intended to represent our jewellery as accurately as possible. Due to photography, lighting, screen settings and natural materials, slight differences in appearance may occur.
Nothing contained in this section excludes or limits any rights that consumers have under the Consumer Protection Act, the Electronic Communications and Transactions Act or any other applicable South African law.
32. Limitation of Liability
To the fullest extent permitted by South African law, Eloria shall not be liable for indirect, incidental, consequential or special damages arising from the use of our website or products where such liability may lawfully be limited.
This includes, where legally permitted:
- loss of profits;
- loss of business opportunities;
- loss of data;
- delays caused by third-party service providers;
- courier delays beyond Eloria's reasonable control; or
- interruptions to website availability.
Nothing contained in these Terms excludes or limits liability for:
- fraud;
- gross negligence where liability cannot lawfully be excluded;
- defective or unsafe products where liability is imposed by law; or
- any statutory rights that cannot legally be excluded.
33. Force Majeure
Eloria shall not be responsible for delays or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control.
These circumstances may include, but are not limited to:
- natural disasters;
- severe weather;
- floods;
- fires;
- acts of terrorism;
- war;
- civil unrest;
- riots;
- strikes;
- supplier disruptions;
- courier disruptions;
- pandemics;
- government action;
- widespread power outages or load shedding;
- internet or telecommunications failures; or
- any other event beyond Eloria's reasonable control.
Where reasonably possible, Eloria will notify affected customers and make reasonable efforts to minimise any disruption.
34. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Any dispute arising from these Terms or the use of the Eloria website shall be subject to the jurisdiction of the South African courts or any other competent forum established under applicable South African law.
Nothing contained in these Terms limits a consumer's right to seek assistance from the:
- Consumer Goods and Services Ombud;
- National Consumer Commission;
- Information Regulator;
- National Consumer Tribunal; or
- any other body established under South African law.
35. Severability
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision shall be severed only to the extent necessary.
The remaining provisions shall remain valid and enforceable.
36. No Waiver
If Eloria delays or chooses not to exercise any right contained in these Terms, this shall not constitute a waiver of that right.
Any waiver shall only be valid if confirmed in writing by Eloria.
37. Entire Agreement
These Terms of Service, together with our:

- Return & Refund Policy;
- Shipping Policy;
- Legal Notice; and
- FAQ,
constitute the complete agreement between Eloria and the customer regarding the use of our website and the purchase of our products.
These documents replace any previous understandings relating to the same subject matter.

Eloria may update these Terms of Service from time to time to reflect:

- changes to our products;
- changes to our services;
- operational improvements;
- security requirements; or
- other reasonable business needs.
